1. OVERVIEW
Welcome to Shabang. These Terms and Conditions ("Terms") govern your access to and use of the Shabang website and our WhatsApp-based ordering service. By accessing our platform or purchasing our products, you agree to be bound by these Terms. If you do not agree to all the terms and conditions, you may not access the website or use any services.
Shabang operates exclusively within the Republic of South Africa.
2. PRODUCT SOURCING, AVAILABILITY, AND LIABILITY
2.1. Sourcing and Manufacturing: Shabang operates as a retailer of curated, internationally and locally sourced lifestyle, beauty, and accessory products. We are not the original manufacturer of these goods. While we strive to source high-quality items, we do not warrant that the quality of any products, services, information, or other material purchased will meet your subjective expectations.
2.2. Spontaneous Inventory: Our inventory is highly limited, and new stock arrives spontaneously. We do not guarantee the restock of any specific item once it is sold out.
2.3. Product Descriptions: We make every effort to display product colors, specifications, and descriptions as accurately as possible. However, we cannot guarantee that your computer or mobile device's display of any color will be accurate.
2.4. Liability: To the maximum extent permitted by South African law, Shabang disclaims any liability for allergic reactions, injuries, or damages resulting from the use of our products (including, but not limited to, eyelash glues, serums, and stainless steel jewelry). Customers use all products at their own risk and must review product ingredients and specifications prior to use.
3. ORDERS AND PAYMENT
3.1. WhatsApp Checkout: All orders are finalized via our official WhatsApp business channel (+27 75 065 6459). Submitting a cart from our website generates an order request; it does not constitute a legally binding contract until payment is received and confirmed by Shabang.
3.2. Payment Methods: We accept payment via Electronic Funds Transfer (EFT) directly from your banking app, or via secure PayShap transfer.
3.3. Payment Clearance: Orders will only be processed and dispatched once funds have fully cleared and reflect in our designated bank account. Proof of payment (POP) is required to secure your limited-stock items, but dispatch remains contingent on cleared funds.
3.4. Pricing: Prices for our products are subject to change without notice. All prices are listed in South African Rand (ZAR).
4. SHIPPING AND DELIVERY
4.1. Delivery Tiers: Shabang offers three distinct delivery tiers:
- Pudo Locker to Locker (R100.00): Nationwide locker collection. Free on orders over R500.
- Standard Door Delivery (R150.00): 1-3 Days depending on the location, available nationwide.
- Same Day Delivery (R200.00): Available strictly within the Cape Town (CPT) area. Orders before 12pm.
4.2. Delays and Force Majeure: We rely on third-party courier services. Shabang shall not be held liable for any delivery delays caused by courier logistics, weather, strikes, load-shedding impacts, or any other circumstances beyond our reasonable control.
4.3. Risk of Loss: The risk of loss and title for items purchased pass to you upon our delivery of the items to the third-party courier.
5. RETURNS, REFUNDS, AND HYGIENE
5.1. Hygiene-Restricted Goods: Due to strict health, safety, and hygiene regulations, we do not accept returns, exchanges, or offer refunds on any jewelry (earrings/studs), eyelash products, glues, serums, or grooming tools once the original packaging has been opened or the product has been used.
5.2. Defective Items: In accordance with the Consumer Protection Act (CPA), if a product is materially defective upon arrival (excluding damage caused by the courier), you must notify us via WhatsApp within 48 hours of delivery, providing clear photographic evidence.
5.3. Return Process: If a return is authorized by Shabang management, the item must be returned in its original, unopened packaging. The customer is responsible for return shipping costs unless the item was sent in error or is proven defective out-of-the-box.
6. LIMITATION OF LIABILITY
In no case shall Shabang, our directors, employees, affiliates, agents, contractors, or suppliers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service.
7. GOVERNING LAW
These Terms and Conditions and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Western Cape, South Africa.
